Moch Incorporated adheres to the Detective Code of Ethics and operates under the trade names: Private Agents Moch, Agents Moch, Detectives Moch, MOCH Agents, Moch Inc, and Private Detectives Moch. Its primary domain is www.agentesprivadosmoch.com and all websites indicated within this domain as its property.

 

2. PURPOSE AND SCOPE OF APPLICATION

2.1. These General Conditions govern access, use, and contracting of private investigation services offered through the website www.agentesprivadosmoch.com and its derived domains (hereinafter, “Website and Derivatives”).

2.2. The use of these services implies full acceptance of these General Conditions, as well as the responses contained in the Frequently Asked Questions section, which form an integral part of these terms.

2.3. Moch Incorporated offers its services in two modalities: “Private Detectives Moch” (direct relationship with the company) and “Independent Detectives” (external professionals who use the platform). In the latter modality, Moch Incorporated acts solely as a promotional medium and does not assume any responsibility for the service provided.

2.4. The User must review the Frequently Asked Questions section before contracting any service. Contracting implies full acceptance of these terms.

 

3. SERVICE PROPERTY RIGHTS

3.1. Moch Incorporated, as the author of a collective work, or any work or performance of any nature, is the holder of the intellectual and industrial property rights of the Website and Derivatives.

3.2. Under no circumstances shall it be understood that User access and navigation imply a waiver, transfer, license, or total or partial assignment of such rights by Moch Incorporated.

3.3. 4.3. The contracting of products and services through the Website and Derivatives by minors of legal age is prohibited, and the prior consent of their parents, guardians, or legal representatives must be duly obtained. Registered User Profile

6.1. The Website and Derivatives makes available to the User different spaces and participation tools to foster conversation and the exchange of ideas and opinions between users, detectives, and detective agencies. Its objective is to remain open and accessible to anyone, provided that basic rules of coexistence and respect are observed.

6.2. User comments are private along with responses and mentions received from other Users.

6.3. The User may follow the activity of services on the Website and Derivatives they find interesting, what is being discussed, and where it takes place. Likewise, the User may follow activity generated by collaborators or editors of the Website and Derivatives, or follow news generated around one or several events, as well as news related to an event or institution.

6.4. The Website and Derivatives may send notifications of User activity and the activity of users they follow via email to the address provided during registration.

6.5. This Profile shall generally be public in nature, but certain private activities (such as follow initiations, moderated content, individual case follow-up notifications, and any other private notifications) will remain hidden and visible only to the User.

 

Participation Rules

6.6. Under no circumstances shall the publication of content that explicitly promotes hatred, contempt, or discrimination on grounds of birth, race, sex, religion, nationality, opinion, or any other personal or social circumstance be permitted. Neither shall attempts to impersonate third parties nor the publication of malicious data be tolerated under any circumstances, regardless of intent.

6.13. The Website and Derivatives expressly declines any responsibility arising from the content hosted by detectives, without prejudice to taking appropriate measures to detect and address complaints about possible illicit activities by them, expressly reserving the right to interrupt at any time and without prior notice, temporarily or permanently, the participation service offered to any detective whose content may be considered illegal, prohibited, or simply inappropriate.

 

7. DISCLAIMER AND LIMITATION OF LIABILITY

7.1. Moch Incorporated provides access to and use of its Website and Derivatives with a reasonable level of competence and diligence. However, it does not guarantee the absence of interruptions, delays, errors, or malfunctions of the system.

7.2. Moch Incorporated shall not be liable for damages of any nature that may arise from the availability and technical continuity of the Website and Derivatives. Whenever reasonably possible, prior notice will be given of any interruptions in the functioning of the Website and Derivatives.

7.3. Moch Incorporated does not assume responsibility for damages that may result from, by way of example but not limited to:

1. Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages, or disconnections in the functioning of the electronic system, caused by deficiencies, overloads, and errors in telecommunication lines and networks, or for any other cause beyond the control of Moch Incorporated;

8. CONTRACTING OF THIRD-PARTY SERVICES THROUGH THE WEBSITE

The User acknowledges and accepts that any contractual or extra-contractual relationship with third-party advertisers contacted through the Website and Derivatives, as well as their participation in promotions, are exclusively between the User and the advertiser and/or third person.
